Patent

What is a patent?

A patent can be applied for by anyone who discovers or invents a new and useful machine, process, or other creation. Patents can also be given for new, substantial and useful improvements to an existing machine or process. The new invention or inventive step must not be obvious to someone with knowledge of the subject.

You can apply for a patent if you think you had invented something
new that no one else had ever thought of

Patents are given only for inventions or inventive modifications.
You cannot get a patent for:

  • a new book, play, or literary work (you can copyright these but not patent them)
  • a new piece of music or painting (you can copyright these but not patent them)
  • a new name or logo (you can trademark these but not patent them)
  • a newly discovered animal, plant or other living thing
  • a new way of doing business or new way of thinking
  • a new scientific discovery
  • a new mathematical theory
